This study examines the existence of a legal vacuum regarding the derivative regulations of Article 54 Paragraph (2) of the National Criminal Code. This legal vacuum raises concerns about potential judicial arbitrariness and questions the protection of victims' rights in the law enforcement process. This research aims to clarify the development of the rechterlijk pardon principle in Indonesia and analyze the review of victims' rights, legal remedies, and the urgency of implementing regulations for rechterlijk pardon. A doctrinal legal research method is employed, utilizing a comparative approach across several countries and a statutory approach. The study concludes that the technical regulations governing the Rechterlijk pardon mechanism create a legal vacuum and emphasizes the necessity of technical regulations to ensure legal certainty, justice, and the protection of victims' rights while preventing revictimization and disparities in access to justice. Without clear regulations, the Rechterlijk pardon poses a risk to the integrity of the judicial system.
