KEPASTIAN HUKUM JUDICIAL RESTRAINT DALAM PENYELENGGARAAN KEKUASAAN KEHAKIMAN OLEH MAHKAMAH AGUNG

Judicial Restraint is an effort to limit judicial power institutions. However, the Supreme Court often, in exercising judicial power, issues regulations whose content violates the law. This research focuses on studying the position of Supreme Court regulations in exercising judicial power and the certainty of judicial constraints on the exercise of judicial power. This research is normative legal research with a case approach. The results of the research show that the legal certainty of judicial restraint in the exercise of judicial power has the aim that the Supreme Court, in dealing with or discovering developments in the dynamics of the problem, must restrain itself or not make regulations that conflict with the law or regulations that have the same content with the law.
